Terms of Service

1. Acceptance of Terms
HostStack is operated by MICCI (CVR: 45587452, Fyrretoften 31, 7100 Vejle, Denmark). By accessing or using HostStack ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service.
2. Description of Service
HostStack provides a cloud hosting platform for deploying web services, databases, and cron jobs on European infrastructure. The Service includes automated deployments from GitHub, GitLab, and Bitbucket; managed databases; custom domain support; and automatic SSL certificates.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
4. Acceptable Use
You agree to use the Service in accordance with our Acceptable Use Policy. Violations of the AUP may result in suspension or termination of your account.
5. Billing, Pricing and VAT
HostStack uses per-resource pay-as-you-go pricing. Each service, database, queue, and search instance has its own monthly price you see before you create it; charges accrue hourly and are invoiced at the end of each billing period. You authorize us to charge your payment method for all fees incurred. We may change prices with 30 days' written notice; existing resources keep their current price for the remainder of the notice window.
VAT: All prices shown on the Service are exclusive of value-added tax (VAT). Danish customers are charged 25% Danish VAT. EU B2C customers outside Denmark are charged destination-country VAT via the EU One Stop Shop (OSS) scheme. EU B2B customers providing a valid VAT identification number are charged 0% under the reverse-charge mechanism (Article 196, EU VAT Directive). Customers outside the EU are not charged VAT.
Refunds are governed by our Refund Policy, including the 14-day statutory right of withdrawal for EU consumers.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy and, where applicable, our Data Processing Agreement. All data is stored on European infrastructure unless you explicitly select a non-EU region at project creation.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance that temporarily affects availability, and we will provide reasonable notice when possible.
8. Termination and Data Deletion
Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease and your data will be permanently deleted within 30 days, unless a longer retention period is required by applicable law (for example, invoices for accounting purposes). 9. Limitation of Liability
To the maximum extent permitted by law, MICCI shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total aggregate liability for any claim arising out of or related to the Service shall not exceed the total fees paid by you to us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under mandatory consumer protection law.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of Denmark, excluding its conflict-of-laws rules. Disputes shall be submitted to the exclusive jurisdiction of Retten i Kolding (the Danish district court whose territorial jurisdiction covers Vejle). If you are an EU consumer, this clause does not deprive you of the protection of mandatory provisions of the law of your country of residence, and you may also bring proceedings in the courts of your home country.
EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be announced by email to the address on your account at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
